Action against the Police - Cyclist awarded
undisclosed sum for police dog attack
Our personal injury solicitors settled a claim for injury and other losses on behalf of cyclist attacked by a police dog. The dog, which was under the control of a Police Constable at the time and not on a lead, attacked the cyclist causing bite marks to his leg. The police force in question admitted liability and our client was awarded an undisclosed sum in compensation.

Our personal injury solicitors represented a keen motorcyclist who suffered a devastating brain injury in the Isle of Man. After the accident our client had to spend many months on rehabilitation units across the UK. During this period his wife supported him vigorously, even resigning from her job to care for him full time. Our solicitors made a successful interim payment which was fought by the Defendant insurer and also undertook a full costing exercise on purchasing and equipping suitable accommodation and recruiting carers ready for his return home. A compensation settlement of £5.4m was secured for our client, four years after the initial accident.

Our solicitors settled a claim for an 11 year old boy in the sum of £2,000,000. He suffered brain injury at birth and has cerebral palsy slightly affecting his left side but is primarily intellectually impaired. As a result he will probably not be able to work and will require some assistance with independent living. His mother, a diabetic received excellent antenatal care but when labour was induced she was left with a very junior Doctor and Midwife, both who failed to recognise signs of fetal distress and effect an earlier delivery. If the delivery was just 45 minutes earlier the birth injury could have been avoided.

Our lawyers secured £1,700,000 in compensation for a motorcyclist who suffered severe spinal injuries in a motorcycle accident. Our client was rendered a tetraplegic in the accident after he was knocked off his motorbike by a farmer whose tractor and trailer were crossing his path on a country lane. After a 2 day trial the judge found the Defendant 85% liable and awarded our client the compensation settlement.

after an accident at work
Our personal injury solicitors settled a claim for £425,000 on behalf of a client who lost his arm following an accident at work. As a floor screeder our client was experienced in working with pump screeding machinery but whilst working with others, and trying to rectify the errors of an electrician on site, he removed the guard from the machine to free the rotating parts of the equipment and injured his arm so badly that it required a below elbow amputation. The settlement was discounted by approximately 25% to take account of his own contribution to the accident as clearly as an experienced operative he should not have removed the cover but arguments relating to a safe system of work and a failure to ensure that the rotating parts of the machine stopped when the cover was removed, led to a recovery of compensation for our self-employed contractor that will assist him to obtain the treatment, aids and equipment and care as well as supplementing his earnings into the future.

Our clinical negligence solicitors settled a claim for £403,000 on behalf of a female client who received negligent care and management of her breast cancer. The hospital failed to recognise the extent of the cancer and failed to give correct treatment including failure to clear the lymph nodes and radiotherapy and chemotherapy in 1994. As a result her life expectancy was significantly reduced. The damages represent compensation for pain, suffering, past losses, future losses and losses arising in the lost years, that is when but for the negligence she would still be alive.

after an accident at work
Our solicitors settled a claim for a 53 year old man who was involved in an accident at work. The claim came through to us in March 2003 some 4 years after the accident happened not as an employers liability claim but as a professional negligence case. Our client's original solicitors had failed to serve Court Proceedings in time and have therefore prevented our client from bringing an industrial accident claim against his employers for 2 fractures to his left elbow and a fracture to his right elbow as well as the psychiatric consequences of suddenly being unable to work and being unable to do things for himself. We pursued a claim against his previous solicitors for the loss of chance suffered. Further evidence was obtained and a settlement achieved at £298,766 which settlement included claims for lost earnings, both past and future, rehabilitation costs such as gymnasium fees, exercise equipment and medication costs as well as travelling expenses and the costs of employing decorators and gardeners as but for the accident, our client would have been able to do things for himself. Claims for care and assistance, both past and future were also submitted.

after a fatal car accident
Our lawyers settled a fatal accident case for a widower following a road traffic accident which took place in 2002. The Claimant and his late wife were involved in a head on collision as they travelled back from a family gathering in a taxi. The Defendant was uninsured and was convicted of causing death by dangerous driving receiving a custodial sentence. The Claimant suffered severe orthopaedic injuries along with psychological symptoms as a result of the loss of his wife. He was unable to return to work and brought a dependency claim along with a claim for his own losses and personal injuries. The claim was settled by the Motor Insurers Bureau in the amount of £200,000.00 in December 2005.

Our lawyers settled an industrial disease compensation claim on behalf of a 54-year old man who contracted asbestos whilst working for his local council's direct works department. A great deal of our client's working life was spent striping out boilers and pipes covered in asbestos and he subsequently contracted the disease. Our lawyers settled the claim within 6 months of being instructed and our client chose to settle for £128,000 whilst still alive.

Our lawyers settled a medical negligence claim for £100,000. The Claimant suffered a spinal fracture in a car accident in 2001 which the Defendant hospital failed to diagnose. Our client received no surgical treatment for over a year during which time she was unable to work and was in severe back pain, resulting in her developing depression. Liability was admitted and the majority of the damages were related to lost earnings.

Our personal injury lawyers settled a claim for a lady who suffered multiple injuries in a road traffic accident. The Claimant was travelling as front-seat seat-belted passenger in the Defendant's motor vehicle when it was involved in a collision with another vehicle. The Claimant fractured her right inferior pubic remus and the left and right acetabulum. She remained in hospital for 4 weeks and upon being discharged had to use a wheelchair for 4 months and remained an outpatient. When the Claimant was discharged she needed extensive care and assistance from her daughter and family.
At the time of the road traffic accident, the Claimant was a bank cashier and was able to return to work, but with significant difficulties as a result of her injuries and at a reduced number of hours. As a result of the Claimant's reduced hours at work, she lost value on her pension entitlement as well as other employee benefits such as options to purchase shares in her employer's company. She received an award of £85,000 in settlement of her car accident compensation claim.
£60,000 awarded to our client in sexual abuse compensation claim
Our solicitors settled a claim for a 38 year old male for the sum of £60,000. The Claimant had suffered serious sexual abuse as a child whilst resident in a local authority care home in the late 1970's. The Claimant was sexually abused by a member of staff at the home over a period of several months and suffered psychiatric damage as a result of the abuse. In addition to the damages awarded our solicitors negotiated the sum of £2,500, which the Defendant agreed to make available to the Claimant for the costs of any private counselling that the Claimant wished to have. The Claim was one of over 70 cases in which our solicitors acted in respect of child abuse at the establishment.

Our personal injury solicitors settled a claim for an elderly man who tripped and fell over a damaged paving stone on a busy shopping street. The Claimant sustained soft tissue injuries to his neck and back, a wrist sprain and cracked ribs which led to an aggravation of a pre-existing bronchial complaint. The local council, who were responsible for the pathway, admitted that they had failed in their duty to maintain the pavement and agreed to compensate the Claimant for his injuries and the financial losses he incurred. The council's public liability insurer agreed an award of damages of £11,000.

Our personal injury solicitors represented a 60 year-old man who suffered a back injury following a head on collision with an uninsured driver. The uninsured driver crossed to our client's side of the carriageway and gave him no chance to avoid a head on collision. In addition to the back injury our client suffered severe abrasions to his head and a whiplash injury to his neck. As a result of the injuries he could no longer play golf and could not assist his wife in caring for their grandchildren. A claim was pursued through the Motor Insurers Bureau Uninsured Driver's agreement and our client was awarded £5,000 in compensation for general damages, pain, suffering and loss of amenity.
£1,900 awarded to our client in holiday accident compensation claim
Our personal injury solicitors acted on behalf of a 64 year-old woman injured in an accident whilst on holiday in Corfu. On arrival in Corfu our client was allocated an apartment located at the top of a steep flight of stairs. At the bottom of the steps was a plinth that had a drop of about 12 inches to ground level. These steps were the only access to and from the apartment. On the third night of the holiday our client was leaving the apartment and followed her husband down the flight of steps. However on this occasion the light that serviced the steps was not working and subsequently the lady did not see the plinth at the bottom of the steps. She tripped and fell and sustained laceration wounds across the entire length of her shins.
Our client was in so much pain that she was forced to cut short her holiday. Our personal injury solicitors and lawyers were instructed to pursue a claim against the holiday company on the grounds that they had been negligent in failing to ensure the steps were adequately lit. In defence the holiday company suggested the accident did not happen at the place in question, the light on the steps was on at the time in question and that even if the light had not been on there was sufficient light from other lights in the complex. The claim proceeded to court and the recorder ruled in our client's favour that there was insufficient light in the hall and vicinity. She was awarded £1,900 in compensation
